Team, We talked a while back for the correct Verbiage needed to stay out of legal issues and ask for more in BAC than what is offered on the MLS. Per the legal hotline and Curtis Bullock you need a 2 fold.
1- Your Buyer Broker Agreement needs to be for the amount that you are requesting. Example: Buyer Broker states 3%. MLS offer is 2.5% can only request an additional 0.5%. If you list 0% on the Buyer Broker Agreement you can’t request more.
2- On an Addendum you put this verbiage “Seller shall pay Buyer’s Brokerage a commission of ____% of the Purchase Price. This payment shall be in addition to any BAC offered by the Listing Brokerage”
